    Dieser Paragraph ist kein eigener Vorwurf, sondern ein Aufschlag, der zu einer anderen Verurteilung dazukommt. Er greift, wenn ein Volljähriger wegen einer der aufgezählten Handelstaten — §§ 11351, 11351.5, 11352, 11378, 11379 oder 11379.6 in den dort genannten Fällen — oder wegen einer Verabredung dazu verurteilt wird und die Tat auf dem Gelände oder im Umkreis von 1.000 Fuss einer Grund-, Berufs-, Mittel- oder Oberschule stattfand, während die Schule für Unterricht oder Programme geöffnet war oder Minderjährige das Gelände gerade nutzten. Der Zuschlag muss in der Anklage ausdrücklich behauptet und dann eingeräumt oder bewiesen werden; das Gericht kann ihn bei mildernden Umständen mit schriftlicher Begründung streichen.

(f) Notwithstanding any other provision of law, the court may strike the additional punishment for the enhancements provided in this section if it determines that there are circumstances in mitigation of the additional punishment and states on the record its reasons for striking the additional punishment.   • Räume für Drogenherstellung oder Drogenlager überlassen

    Wer ein Gebäude, einen Raum, eine Fläche oder ein umschlossenes Gelände verwaltet oder darüber bestimmt — als Eigentümer, Mieter, Vertreter, Angestellter oder Hypothekengläubiger —, macht sich strafbar, wenn er es wissentlich vermietet, verpachtet oder sonst zur Verfügung stellt, damit dort Drogen hergestellt, gelagert oder zum Verkauf verteilt werden. Ob dafür Geld fliesst, spielt keine Rolle. Ein schwererer Absatz gilt, wenn der Verantwortliche wissentlich zulässt, dass die Räume gegen den Zugriff der Polizei verbarrikadiert werden, um den Verkauf von Kokain, Crack, Heroin, PCP, Amphetamin, Methamphetamin oder LSD zu ermöglichen, und er daraus übermäßigen Gewinn zieht. The court shall transmit all penalties collected pursuant to this subdivision to the county treasurer of the county in which the court is located for deposit in a special account in the county treasury. The county treasurer shall pay that money at least once a month to the agency that requested recovery of the cost for the removal action. The county may retain up to 5 percent of any assessed penalty for appropriate and reasonable administrative costs attributable to the collection and disbursement of the penalty. (2) If the Department of Toxic Substances Control has requested recovery of the cost of removing the hazardous substance that is a controlled substance or a chemical used in, or is a byproduct of, the manufacture of a controlled substance or taking removal action with respect to any release of the hazardous substance, the county treasurer shall transfer funds in the amount of the penalty collected to the Treasurer, who shall deposit the money in the Illegal Drug Lab Cleanup Account, which is hereby created in the General Fund in the State Treasury. The Department of Toxic Substances Control may expend the money in the Illegal Drug Lab Cleanup Account, upon appropriation by the Legislature, to cover the cost of taking removal actions pursuant to Article 16 (commencing with Section 79350) of Chapter 5 of Part 2 of Division 45. (3) If a local agency and the Department of Toxic Substances Control have both requested recovery of removal costs with respect to a hazardous substance that is a controlled substance or a chemical used in, or is a byproduct of, the manufacture of a controlled substance, the county treasurer shall apportion any penalty collected among the agencies involved in proportion to the costs incurred. (c) As used in this section the following terms have the following meaning: (1) “Dispose” means to abandon, deposit, intern, or otherwise discard as a final action after use has been achieved or a use is no longer intended. (2) “Hazardous substance” has the same meaning as defined in subdivision (a) of Section 78075. (3) “Hazardous waste” has the same meaning as defined in Section 25117.   • Zuschlag: Drogenhandel an Entzugsklinik oder Obdachlosenunterkunft

    Dieser Paragraph ist kein eigener Vorwurf, sondern ein Aufschlag, der zu einer anderen Verurteilung dazukommt. Er greift, wenn jemand wegen Handels mit Heroin, Kokain, Crack, Methamphetamin oder PCP — oder wegen einer Verabredung dazu — verurteilt wird und die Tat auf dem Gelände oder im Umkreis von 1.000 Fuss einer Suchtklinik, einer Entzugseinrichtung oder einer Obdachlosenunterkunft stattfand. „Handel“ meint die Taten der §§ 11351, 11351.5, 11352, 11353, 11354, 11378, 11379, 11379.6 und 11380; blosser Besitz und blosser Konsum zählen ausdrücklich nicht. Der Zuschlag muss in der Anklage behauptet und dann eingeräumt oder bewiesen werden. Er entfällt, wenn schon ein Zuschlag nach §§ 11353.1, 11353.5, 11353.6, 11353.7 oder 11380.1 verhängt wird. Das Gericht kann ihn streichen und soll dabei unter anderem berücksichtigen, ob der Verurteilte selbst obdachlos oder abhängig ist und nur den eigenen Bedarf decken wollte — oder umgekehrt, ob er gezielt Obdachlose und Suchtkranke ausgenutzt hat.

Der Zuschlag muss in der Anklage behauptet und dann eingeräumt oder bewiesen werden. Er entfällt, wenn schon ein Zuschlag nach §§ 11353.1, 11353.5, 11353.6, 11353.7 oder 11380.1 verhängt wird. (1) The following factors indicate that the court should exercise its discretion to strike the additional punishment unless these factors are outweighed by factors in aggravation: (A) The defendant is homeless, or is in a homeless shelter or transitional housing. (B) The defendant lacks resources for the necessities of life. (C) The defendant is addicted to or dependent on controlled substances. (D) The defendant’s motive was merely to maintain a steady supply of drugs for personal use. (E) The defendant was recruited or exploited by a more culpable person to commit the crime. (2) The following factors indicate that the court should not exercise discretion to strike the additional punishment unless these factors are outweighed by factors in mitigation: (A) The defendant, in committing the crime, preyed on homeless persons, persons with substance use disorder, or substance abusers who were seeking treatment, shelter or transitional services. (B) The defendant’s primary motive was monetary compensation. (C) The defendant induced others, particularly homeless persons, persons with substance use disorder, and substance abusers, to become involved in trafficking. (d) For the purposes of this section, the following terms have the following meanings: (1) “Detoxification facility” means any premises, place, or building in which 24-hour residential nonmedical services are provided to adults who are recovering from problems related to alcohol, drug, or alcohol and drug misuse or abuse, and who need alcohol, drug, or alcohol and drug recovery treatment or detoxification services. (2) “Drug treatment program” or “drug treatment” has the same meaning set forth in subdivision (b) of Section 1210 of the Penal Code. (3) “Homeless shelter” includes, but is not limited to, emergency shelter housing, as well as transitional housing, but does not include domestic violence shelters. “Emergency shelter housing” is housing with minimal support services for homeless persons in which residency is limited to six months or less and is not related to the person’s ability to pay. “Transitional housing” means housing with supportive services, including self-sufficiency development services, which is exclusively designed and targeted to help recently homeless persons find permanent housing as soon as reasonably possible, limits residency to 24 months, and in which rent and service fees are based on ability to pay. (4) “Trafficking” means any of the unlawful activities specified in Sections 11351, 11351.5, 11352, 11353, 11354, 11378, 11379, 11379.6, and 11380. It does not include simple possession or drug use.

    Das Gericht nimmt eine dieser drei Zahlen. Dazwischen gibt es nichts — „16 Monate · 2 Jahre · 3 Jahre“ heisst nicht „von … bis“.

    • Die mittlere ist der Normalfall. Sie gilt, solange nichts dagegenspricht.
    • Die obere nur, wenn es besonders schlimm war — und das muss bewiesen sein. „Wahrscheinlich“ reicht nicht.
    • Die untere, wenn etwas dafür spricht: erlittenes Trauma, Jugend zur Tatzeit, Gewalt in der Partnerschaft.
