(e) Subdivision (b) does not apply to any person who brings or possesses an ice pick or a knife having a fixed blade longer than 21/2 inches upon the grounds of, or within, any private university, state university, or community college for lawful use in or around a residence or residential facility located upon those grounds or for lawful use in food preparation or consumption. (f) Subdivision (a) does not apply to any person who brings an instrument that expels a metallic projectile, such as a BB or a pellet, through the force of air pressure, CO2 pressure, or spring action, or any spot marker gun, or any razor blade or box cutter upon the grounds of, or within, a public or private school providing instruction in kindergarten or any of grades 1 to 12, inclusive, if the person has the written permission of the school principal or his or her designee. (g) Any certificated or classified employee or school peace officer of a public or private school providing instruction in kindergarten or any of grades 1 to 12, inclusive, may seize any of the weapons described in subdivision (a), and any certificated or classified employee or school peace officer of any private university, state university, or community college may seize any of the weapons described in subdivision (b), from the possession of any person upon the grounds of, or within, the school if he or she knows, or has reasonable cause to know, the person is prohibited from bringing or possessing the weapon upon the grounds of, or within, the school. (h) As used in this section, “dirk” or “dagger” means a knife or other instrument with or without a handguard that is capable of ready use as a stabbing weapon that may inflict great bodily injury or death. (i) Any person who, without the written permission of the college or university president or chancellor or his or her designee, brings or possesses a less lethal weapon, as defined in Section 16780, or a stun gun, as defined in Section 17230, upon the grounds of, or within, a public or private college or university campus is guilty of a misdemeanor.

    (a) A person who is exempt from Section 27545 or is otherwise not required by law to report the acquisition or ownership of a firearm may submit that information to the Department of Justice in a manner and format prescribed by the department. (b) The form described in subdivision (a) shall include, without limitation, all of the following information: (1) The name, gender, date and place of birth, address, and telephone number of the applicant. (2) The country of citizenship of the applicant and, if not a citizen of the United States, proof of lawful presence including a permanent resident number or Arrival/Departure Record card (I-94) number. (3) The make, model, caliber, barrel length, type, country of origin, and serial number of the firearm, or, if the firearm does not have a serial number, the identification number, or identification mark assigned to it. (4) The applicant’s valid California driver’s license number or valid California identification card number issued by the Department of Motor Vehicles, or a copy of the applicant’s military identification with orders indicating that the individual is stationed in California. (5) The signature of the applicant and the date of such signature. (c) Furnishing a fictitious name or address, knowingly furnishing any incorrect information, or knowingly omitting any information required to be provided for the form described in subdivision (b) is punishable as a misdemeanor. (d) The department shall establish a fee for submission of the form described in subdivision (a) and an additional fee for each additional firearm. This fee shall not exceed the reasonable and actual costs of processing the form submitted pursuant to this section. The department may annually review and adjust this fee to fully fund, but not exceed, these costs. (e) Upon receipt of a completed application submitted pursuant to this section and any required fee, the department shall examine its records, as well as those records that it is authorized to request from the State Department of State Hospitals pursuant to Section 8104 of the Welfare and Institutions Code, and records available to the department in the National Instant Criminal Background Check System, to determine if the purchaser is prohibited by state or federal law from possessing, receiving, owning, or purchasing a firearm. (f) (1) A person not otherwise required to report the destruction, disposal, dispossession, relinquishment, or transfer of a firearm, may report the destruction, disposal, dispossession, relinquishment, or transfer of that firearm to the department, in a manner and format prescribed by the department. (2) A person who moves out of this state with a firearm and is no longer a resident of this state may report their move to the department, in a manner and format prescribed by the department. (g) The department may request photographs of the firearms reported pursuant to this section to determine if the firearm is a generally prohibited weapon, assault weapon, or machinegun, or is otherwise prohibited. (h) The department may request documentation, which would provide proof a firearm has been transferred, destroyed, disposed of, or permanently removed from this state. Documentation may include copies of receipts, forms, government-issued identification cards, and photographs to determine if the firearm is no longer possessed by the reporting party, or has been removed from this state. The department may reject the report if the department determines the documentation provided is insufficient to prove transfer, destruction, dispossession, or removal from this state.

A public transit system includes the vehicles used in the system, including, but not limited to, motor vehicles, streetcars, trackless trolleys, buses, light rail systems, rapid transit systems, subways, trains, or jitneys, that transport members of the public for hire. (2) “Firearm” has the same meaning as specified in subdivisions (a) and (b) of Section 16520. (b) It is unlawful for a person to knowingly possess any of the following in a public transit facility: (1) A firearm. (2) An imitation firearm as defined in subdivision (a) of Section 16700. (3) An instrument that expels a metallic projectile, such as a BB or pellet, through the force of air pressure, CO2 pressure, or spring action, or a spot marker gun or paint gun. (4) A metal military practice hand grenade. (5) A metal replica hand grenade. (6) A plastic replica hand grenade. (7) An unauthorized tear gas weapon. (8) An undetectable knife, as described in Section 17290. (9) An undetectable firearm, as described in Section 17280. (c) (1) Subdivision (b) does not apply to, or affect, any of the following: (A) A duly appointed peace officer as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2. (B) A retired peace officer with authorization to carry concealed weapons as described in Article 2 (commencing with Section 25450) of Chapter 2 of Division 5 of Title 4 of Part 6. (C) A full-time paid peace officer of another state or the federal government who is carrying out official duties while in California. (D) A qualified law enforcement officer of another state or the federal government, as permitted under the Law Enforcement Officers Safety Act pursuant to Section 926B or 926C of Title 18 of the United States Code. (E) A person summoned by an officer listed in subparagraphs (A) to (C), inclusive, to assist in making arrests or preserving the peace while they are actually engaged in assisting the officer. (F) A person who is responsible for the security of the public transit system and who has been authorized by the public transit authority’s security coordinator, in writing, to possess a weapon specified in subdivision (b). (G) A person possessing an unloaded firearm while traveling on a public transit system that offers checked baggage services, so long as the firearm is stored in accordance with the public transit system’s checked baggage policies. (2) Paragraph (7) of subdivision (b) does not apply to or affect the possession of a tear gas weapon when possession is permitted pursuant to Division 11 (commencing with Section 22810) of Title 3 of Part 6. (3) Paragraph (1) of subdivision (b) does not apply to a person transporting an unloaded firearm locked in a lock box in compliance with paragraph (8) of subdivision (a) of Section 26230. (d) A violation of this section is punishable by imprisonment in a county jail for a period not exceeding six months, or by a fine not exceeding one thousand dollars ($1,000), or by both that fine and imprisonment. (e) The provisions of this section are cumulative and do not restrict the application of any other law. However, an act or omission that is punishable in different ways by this and any other provision of law shall not be punished under more than one provision. (f) This section does not prevent prosecution under any other provision of law that may provide a greater punishment. (g) This section shall be interpreted so as to be consistent with Section 926A of Title 18 of the United States Code.

  • Entfernen oder Verändern der Waffenkennzeichnung

    Strafbar ist, wer den Namen des Herstellers, das Modell, die Herstellernummer oder ein anderes Kennzeichen an einer Pistole, einem Revolver oder einer sonstigen Schusswaffe verändert, abwandelt, entfernt oder unkenntlich macht. Erfasst sind auch die vom Justizministerium vergebenen Unterscheidungsnummern und -zeichen. Erlaubt ist das nur mit vorheriger schriftlicher Genehmigung des Ministeriums.

    Der Strafrahmen im Gesetz

    16 Monate·2 Jahre·3 Jahre?

    Das Gericht nimmt eine dieser drei Zahlen. Dazwischen gibt es nichts — „16 Monate · 2 Jahre · 3 Jahre“ heisst nicht „von … bis“.

    • Die mittlere ist der Normalfall. Sie gilt, solange nichts dagegenspricht.
    • Die obere nur, wenn es besonders schlimm war — und das muss bewiesen sein. „Wahrscheinlich“ reicht nicht.
    • Die untere, wenn etwas dafür spricht: erlittenes Trauma, Jugend zur Tatzeit, Gewalt in der Partnerschaft.
