  • Strafschärfung bei wiederholtem Fahrzeugmissbrauch

    Wer wegen unbefugter Fahrzeugbenutzung oder Fahrzeugdiebstahls verurteilt war, dafür in Haft saß oder als Bewährungsauflage inhaftiert war, und danach erneut wegen unbefugter Benutzung eines Fahrzeugs oder Boots (§ 499b) verurteilt wird, erhält eine erhöhte Strafe. Dasselbe gilt für jemanden, der bereits zweimal oder öfter in getrennten Verfahren wegen § 499b in Bezug auf Fahrzeuge oder Boote verurteilt und mindestens einmal inhaftiert war.

    Der Strafrahmen im Gesetz

    Das Gericht nimmt eine dieser drei Zahlen. Dazwischen gibt es nichts — „16 Monate · 2 Jahre · 3 Jahre“ heisst nicht „von … bis“.

    • Die mittlere ist der Normalfall. Sie gilt, solange nichts dagegenspricht.
    • Die obere nur, wenn es besonders schlimm war — und das muss bewiesen sein. „Wahrscheinlich“ reicht nicht.
    • Die untere, wenn etwas dafür spricht: erlittenes Trauma, Jugend zur Tatzeit, Gewalt in der Partnerschaft.
