The defendant shall produce documentation of program enrollment to the court within 30 days of enrollment, along with quarterly progress reports. (B) The terms of probation for offenders shall not be lifted until all reasonable fees due to the counseling program have been paid in full, but in no case shall probation be extended beyond the term provided in subdivision (a) of Section 1203.1. If the court finds that the defendant does not have the ability to pay the fees based on the defendant’s changed circumstances, the court may reduce or waive the fees. (4) If the offense was committed while the defendant was under the influence of drugs or alcohol, the defendant shall abstain from the use of drugs or alcohol during the period of probation and shall be subject to random drug testing by his or her probation officer. (5) The court may waive any of the above minimum conditions of probation upon a finding that the condition would not be in the best interests of justice. The court shall state on the record its reasons for any waiver.

  • Strafschärfung bei Kindesmisshandlung mit Todesfolge

    Wer wegen Kindesmisshandlung nach § 273a verurteilt wird, weil er unter Umständen, die eine schwere Schädigung oder den Tod erwarten liessen, ein Kind vorsätzlich hat leiden lassen oder ihm ungerechtfertigte Schmerzen oder Verletzungen zugefügt hat, und das Kind dadurch stirbt, erhält für jeden Verstoss eine Zusatzstrafe. Dasselbe gilt für Aufsichtspflichtige, die eine tödliche Schädigung des Kindes zulassen.

    (a) Upon conviction of any person for a violation of Section 273a, 273d, 288.5, 311.2, 311.3, or 647.6, the court may, in addition to any other penalty or restitution fine imposed, order the defendant to pay a restitution fine based on the defendant’s ability to pay not to exceed five thousand dollars ($5,000), upon a felony conviction, or one thousand dollars ($1,000), upon a misdemeanor conviction, to be deposited in the Restitution Fund to be transferred to the county children’s trust fund for the purposes of child abuse prevention.

    Das Gericht nimmt eine dieser drei Zahlen. Dazwischen gibt es nichts — „16 Monate · 2 Jahre · 3 Jahre“ heisst nicht „von … bis“.

    • Die mittlere ist der Normalfall. Sie gilt, solange nichts dagegenspricht.
    • Die obere nur, wenn es besonders schlimm war — und das muss bewiesen sein. „Wahrscheinlich“ reicht nicht.
    • Die untere, wenn etwas dafür spricht: erlittenes Trauma, Jugend zur Tatzeit, Gewalt in der Partnerschaft.
