    (a) A motor vehicle shall not be operated in a manner resulting in the escape of excessive smoke, flame, gas, oil, or fuel residue. (b) A nongasoline heavy-duty onroad motor vehicle with a gross vehicle weight rating of more than 14,000 pounds shall not be operated in a manner resulting in the escape of visible smoke, except during active regeneration. (c) (1) A violation of this section is a correctable violation pursuant to Article 4 (commencing with Section 40610) of Chapter 2 of Division 17. Except as provided in paragraph (2) and subdivision (d), an owner or operator of a vehicle found to be in violation of this section shall have 45 days to correct the violation and the vehicle shall not be prohibited from being used during this time. (2) Except as provided in subdivision (d), an owner or operator of a vehicle that is used exclusively in the conduct of agricultural operations and that is found to be in violation of this section shall have a time period determined by the State Air Resources Board that is not less than 75 days from the date of the citation to correct the violation and the vehicle shall not be prohibited from being used during that time. (d) Notwithstanding subdivision (c), a vehicle found to have willfully tampered emission controls, including the vehicle’s onboard diagnostics system, shall not be operated. (e) This section applies to motor vehicles of the United States or its agencies, to the extent authorized by federal law.

    Verboten ist, ein in Kalifornien zugelassenes Motorrad zu parken, zu benutzen oder zu fahren, wenn an der Auspuffanlage die vorgeschriebene Plakette der US-Umweltbehörde EPA fehlt. Das gilt als technischer Mangel: Die Polizei darf ein Motorrad nicht allein wegen dieses Verdachts anhalten, sondern den Verstoß nur zusätzlich zu einem anderen Anlass aufschreiben. Wer den Mangel behebt und das nachweist, dem kann das Gericht die Strafe beim ersten Verstoß erlassen. Die Vorschrift gilt für Motorräder und Nachrüst-Auspuffanlagen ab Baujahr 2013.

    (2) For a second or subsequent conviction, by a fine of not less than one hundred dollars ($100), nor more than two hundred fifty dollars ($250).

    (B) Upon a finding that a second offense or subsequent offense has been committed, complete six hours of drug education or counseling and up to 20 hours of community service over a period not to exceed 90 days.

    (2) Persons at least 18 years of age but less than 21 years of age are guilty of an infraction and punishable by a fine of not more than one hundred dollars ($100).

    (b) Except as authorized by law, possession of more than 28.5 grams of cannabis, or more than eight grams of concentrated cannabis, shall be punished as follows:

    (1) Persons under 18 years of age who possess more than 28.5 grams of cannabis or more than eight grams of concentrated cannabis, or both, are guilty of an infraction and shall be required to:

    (1) A fine of not more than two hundred fifty dollars ($250), upon a finding that a first offense has been committed.

    (2) A fine of not more than five hundred dollars ($500), or by imprisonment in a county jail for a period of not more than 10 days, or both, upon a finding that a second or subsequent offense has been committed.

    (d) Except as authorized by law, a person under 18 years of age who possesses not more than 28.5 grams of cannabis, or not more than eight grams of concentrated cannabis, upon the grounds of, or within, any school providing instruction in kindergarten or any of grades 1 to 12, inclusive, during hours the school is open for classes or school-related programs is guilty of an infraction and shall be punished in the same manner provided in paragraph (1) of subdivision (b).
